Supreme Court tariffs, birthright citizenship rulings hit US budget

Former President Donald Trump asserted that recent Supreme Court decisions have imposed a financial burden on the nation measured in the trillions of dollars.

In a post on his social platform, he asked whether anyone could estimate the monetary and prestige loss from the Court’s rulings on birthright citizenship and tariffs, responding that the amount reached “trillions and trillions of dollars.”

Earlier this year the Court ruled that the International Emergency Economic Powers Act does not grant the president authority to impose tariffs, thereby limiting executive power over trade measures.

The high court also rejected a presidential executive order that sought to curtail birthright citizenship, reaffirming the constitutional provision that confers citizenship on individuals born on U.S. soil.

The 14th Amendment states that all persons born or naturalized in the United States, and subject to its jurisdiction, are citizens of the United States and of the state wherein they reside.

Trump’s executive order declared that no federal agency should recognize citizenship for individuals whose mother was unlawfully present in the United States, or whose mother’s lawful but temporary presence coincided with a father who was not a citizen or lawful permanent resident at the time of birth.

The order aimed to restrict citizenship documentation for children of undocumented immigrants, but the Court found it inconsistent with constitutional guarantees.

During his first term, Trump appointed three of the nine current justices—Brett Kavanaugh, Neil Gorsuch, and Amy Coney Barrett—shaping the Court’s composition.
