US Citizenship and Immigration Services (USCIS) has rescinded a previous rule that prevented immigration officials from considering an individual's risk of becoming reliant on public services such as food stamps, Medicaid, and housing assistance. This change will allow USCIS officers to assess all relevant factors on a case-by-case basis for each applicant.
The previous rule, put in place during the Biden administration, restricted which public benefits could be considered by immigration officials. USCIS has stated that the new rule will give officers the ability to review all relevant factors as intended by Congress. This aligns with the Immigration and Nationality Act (INA), which deems an individual inadmissible if they are likely to become a public charge at any time.
The new rule will reportedly impact hundreds of thousands of green card applicants inside the US. Under the INA, some individuals can be deemed inadmissible if the government determines they are likely to become a public charge. This includes considering factors such as age, health, family status, assets, financial resources, education, skills, and whether the person has received means-tested taxpayer-funded benefits.
The federal government has reaffirmed the requirement of self-reliance, protecting public resources and ending policies that encouraged dependency on the backs of hard-working American taxpayers. Director Joseph Edlow stated that this change will restore the basic principle that immigrants must be able to support themselves. The Trump administration is committed to upholding the rule of law and protecting American taxpayers from subsidizing aliens who may become dependent on public benefits.
