A legal battle ignited Thursday as a lawsuit challenged the federal government’s practice of imposing staggering fines – potentially reaching $1.8 million per individual – on immigrants residing in the United States without authorization.

More than 21,500 immigrants have been subjected to daily penalties of $998, a measure intended to compel them to leave the country. However, their legal representatives argue these individuals were actively attempting to navigate the complex U.S. immigration system when the fines were levied.

Lawyers decry the fines as “ruinous” and “grossly disproportionate,” asserting they violate constitutional principles. The lawsuit, filed in Massachusetts, seeks class-action status, aiming to represent all those burdened by penalties exceeding a collective $6 billion under recent deportation policies.

“Our clients are diligently following the legal pathways for relief, engaging with immigration courts and agencies as required,” explained Hasan Shafiqullah, a supervising attorney. “Yet, the government responds by threatening to confiscate their livelihoods – their wages, vehicles, even their homes.”

One plaintiff, identified as Nancy M. to safeguard her from potential repercussions, resides in Florida and was under an “order of supervision” while pursuing legal permanent residency. She diligently met with immigration officials annually, attempting to fulfill all requirements.

Despite her compliance, Nancy M. received a bill earlier this year for approximately $1.8 million, calculated from the daily $998 fine accrued over the past five years. The sheer magnitude of the debt threatens to dismantle her life.

The Department of Homeland Security defended the fines as a legitimate enforcement of federal immigration law, dismissing the lawsuit as an attempt to circumvent established regulations. A spokesperson stated the plaintiffs are “suing so they can remain in the country illegally without any consequence.”

The imposition of these financial penalties followed a series of policy shifts announced shortly after the change in administration, signaling a renewed emphasis on encouraging self-deportation. Officials declared a firm message: those residing in the country illegally must leave.

The administration vowed to enforce all immigration laws without exception, signaling a commitment to strict adherence to existing regulations and a willingness to utilize financial penalties as a tool for enforcement.
